Questgates warns on riot claims time limits

Questgates is warning that insurance claims resulting from recent riotous behavior could be invalidated by the slightest of delays.

According to the claims management firm, local police authorities have a legal responsibility to reimburse persons who sustain damage to property as the result of a riot under the Riot Damages Act 1886.

However, any claim under the Act must be made in writing and received by the local police authority within 14 days of the alleged incident.

Insurers therefore typically include within policy claims notification clauses a requirement for any claim for riot and/or civil commotion to be notified to insurers immediately, followed by full supporting documentation (a schedule of loss and statement of truth) within seven days of the incident.

Insurers are then entitled to recover their outlays under the principle of subrogation.

Questgates also advises that the Act excludes liability for loss or damage to cars left on public highways, goods left in shops for repair and/or consequential losses.

PIP Contributes to Rise in Auto Insurance Claims Costs

Auto insuranceclaims are on the rise across the country according to a new report released by the Insurance Research Council (IRC). The report, issued this week, found that the increase in costs is reversing previous trends of relatively stable costs that have even declined in some cases.

Auto Insurance Claims Severity and Frequency Increasing

The new Insurance Research Council report, titled Trends in Auto Injury Claims, 2011 Edition, has revealed some shifts in previous auto insurance claims trends.

In the previous few years, reports from the IRC found that while injury claim severity (the average cost of injury claims) has been on the rise, it has always been offset by declining claim frequency. However, according to the 2011 report, the frequency in which claims are filed has increased, resulting in an overall jump in claims costs.

PIP Claims Have Impacted Total Claims

Among the types of auto insurance claims studied by the IRC, the organization said personal injury protection (PIP) claimsalso known as no-fault injury protectionseemed to have had the greatest impact on the claims cost increase.

Car insurers must crack down on ‘whiplash epidemic’ say MPs

The spiralling cost of car insurance premiums could be curbed if the government clamped down on whiplash claims and insurers were banned from selling on customer information, according to MPs.

In a report, the transport select committee warned that soaring premiums are “primarily the result of market dysfunction and, in particular, the escalation of uncontested claims for whiplash injury”.

According to the Association of British Insurers, whiplash claims are now costing insurers and customers more than £2bn a year. This adds an extra £90 to the average motor insurance premium.

Over the last three years, says the ABI, the number of people claiming whiplash has jumped by 32% to 570,000 a year, but the number of accidents reported (less than 210,000) has fallen by 16%.

The transport committee called for the government to raise the threshold for the payment of any compensation in whiplash cases. “

As many of you commuters in the Southfield and Farmington Hills area know, a six-mile stretch of I-696 was shut down this morning for many hours.

The reason for such drastic measures by police is a great tragedy. A pedestrian was trying to change a tire when he was struck multiple times and killed on the highway, according to published reports. After the initial crash, there was a subsequent auto accident that sent three people to the hospital.

Police are still investigating the accident, and they are asking that anyone with information, who might have seen something or struck something, call the Michigan State Police at (248) 584-5740.

If you keep a vehicle primarily as a collector’s item, standard auto insurance coverage is likely unnecessary because such vehicles are rarely driven and don’t require extensive insurance protection. For example, you might have an exotic Italian sports coupe that you only drive for a few weeks in the summer, or a 1976 Pontiac Firebird Trans Am that you only drive back and forth to an occasional auto show. Rarely driven show vehicles like these are best covered by classic auto insurance. Such policies offer the same protections as standard policies but, because the insured vehicle spends the majority of the year in storage, are substantially less expensive.

Qualifying for Antique Car Insurance

You and your vehicle will need to meet the carriers requirements in order to qualify for a collector car insurance policy. Generally speaking, most carriers will accept antique and classic, new exotic, lowrider, retired commercial, and street rod vehicles provided they and their drivers meet the following criteria (specific requirements will vary by carrier):

  • Mileage – antique auto insurance will only cover vehicles driven infrequently, such as for shows, tours, events, and short-distance pleasure driving.

Talk about a sticky situation.

Travelers Insurance has asked a federal court in Pennsylvania to appoint a “special master” to evaluate and settle the claims of hundreds of motorists whose vehicles were damaged after a tanker truck insured by the coverage provider spilled a gooey petroleum product all over the Pennsylvania Turnpike in November.

A lawyer representing Travelers confirmed this week that the insurer has deposited $1 million into a bank account supervised by the U.S. District Court in Pittsburgh, but said that amount may not be enough to pay off the nearly 1,000 claims for damages filed by motorists from 16 states and their private insurance companies.
