Questgates warns on riot claims time limits

Questgates is warning that insurance claims resulting from recent riotous behavior could be invalidated by the slightest of delays.

According to the claims management firm, local police authorities have a legal responsibility to reimburse persons who sustain damage to property as the result of a riot under the Riot Damages Act 1886.

However, any claim under the Act must be made in writing and received by the local police authority within 14 days of the alleged incident.

Insurers therefore typically include within policy claims notification clauses a requirement for any claim for riot and/or civil commotion to be notified to insurers immediately, followed by full supporting documentation (a schedule of loss and statement of truth) within seven days of the incident.

Insurers are then entitled to recover their outlays under the principle of subrogation.

Questgates also advises that the Act excludes liability for loss or damage to cars left on public highways, goods left in shops for repair and/or consequential losses.

A general hospital in Kettering has revealed it has paid out just under $3m in medical negligence claims over the past year.

Any of the 28 incidents could have occurred at any point since 1995; however, the claims have just come to light over the previous 12 months. There are no details about the cases, but the compensation includes: $1.7 million in damages and about $1 million in costs for the hospital.

In January 2010, it was revealed that there were plans to improve the hospitals safety, and a patient’s survey conducted in 2009 showed that a main question concerning patients was if they were safe in the hands of the hospital. This led to an internal safety campaign being launched, where the main implementations were for the staff to accompany patients around the hospital where they identify any safety problems concerning them. Car insurance claims are being debated by motorists at the moment as there has been an increase in the number of people denying responsibility for accidents by blaming icy roads, according to a report.

Experts at Accident Exchange said that the cost of insurance premiums could rise as a result because liability disputes prolong the settlement process and the associated costs borne by the industry may be passed on to consumers.

Lee Woodley, spokesperson for the company, said that the laws surrounding liability are clear.

“Just because the car in front slides on the snow or ice, and you end up hitting them too, the fault is still yours. They may have lost control, but so did you,” he explained.

Accident Exchange cited Section 230 of the Highway Code which states that road users need to keep well back from the vehicle in front as stopping distances can be ten times greater in snowy and icy conditions.

The Met Office’s most recent forecast said that icy conditions and severe frosts would follow the heavy snow.
